Job Description
Contract Managers take responsibility for managing large clients and/or a portfolio of clients in a manner that maximises value for Avanade and clients. Contract Managers operate in close collaboration with sales and delivery teams and be recognized as a trusted advisor throughout the entire contract lifecycle.
Contract Managers must be capable of managing complex, risky, high value contracts and subcontracts in accordance with company policies and procedures, applicable laws and client business requirements. Contract Managers are generally co-located with Avanade business/client units and project teams and are expected to maintain a high level of visibility on the account as they perform their contract management responsibilities.
Contract Managers also take accountability for commercial and contractual outcomes and acting as a role model for contract management staff and a trusted partner to the business.
This role supports Avanade Government accounts and contracts.
Key Responsabilities
Leadership/Engagement:
· Lead contract management activities on a specific project or account;
· Work with project and account managers to ensure contract management support meets the day-to-day requirements of the business and work with client commercial and business stakeholders to understand and support client needs and priorities as needed;
· Demonstrate the value of the contract management function with business and account leaders;
· Steward applicable best practices training and adoption;
· Proactively liaise with Finance, Legal, Operations, Delivery, and Subject Matter Advisors as needed to support the project;
· Leader as well as team player, collaborative and persuasive; able to work well with executives and non-executives;
· Ability to operate with independence and minimal supervision, but willing to take direction; and
· Work with account teams in order to understand critical business and delivery requirements.
Risk & Issue Management:
· Identify and resolve commercial and contract risks and issues, working with account leadership to ensure appropriate mitigations strategies are developed;
· Escalate contractual, commercial and CM positioning matters in a timely and controlled fashion (in accordance with prescribed consultation guidelines) and ensure affected parties are notified in an appropriate manner;
· Lead or assist actions or analyses needed to protect revenue or mitigate work at risk; and
· Draft, review and approve weekly, monthly and quarterly reports in compliance with contract management processes and account delivery requirements.
Sales Support:
· Provide support for pre-award sales activities, assisting with proposal reviews and working with deal teams to review contract terms and conditions and coordinating document execution;
· Support reviews of bids or proposal responses as needed; and
· Demonstrate reasonable knowledge and understanding of Avanade's consulting, outsourcing and systems integration service offerings and associated commercial considerations (e.g. different Avanade workforces, cost and pricing structures, SLA's & delivery timescales) and build awareness and education within your CM teams.
Contracting, Drafting and Negotiation:
· Draft and review Statements of Work, Change Requests, Arrangement Letters, Subcontracts and Non-Disclosure Agreements, working with project leadership to facilitate timely reviews and quality contractual documents that are fit for purpose and ensure business/Legal approvals;
· Maintain an updated repository of agreed contract templates; and
· Participate in negotiations to achieve the best outcomes for Avanade and clients.
Mobilization and Post-Award Processes, Procedures, and Compliance:
· Following execution of new contracts, support or lead applicable areas of post-award contract mobilization;
· Help team understand and define robust Governance procedures;
· Create and deploy necessary contract awareness to Delivery and Account Leadership;
· Identify, define, create, and deploy processes needed for post-award compliance and management, including those related to government requirements, such as regulatory and trade compliance;
· Develop, share, and when appropriate, act on knowledge of commercial levers;
· Support contractual tracking and reporting needs;
· Support data protection planning and training, as needed; and
· Lead or support any needed post-award trainings related to contractual awareness or compliance.
Knowledge Skills and Experience
Education:
· University degree required (business, computing, law or engineering preferred).
Contract Management Knowledge and Experience:
· Min 5 years relevant experience as a contract manager in Public sector (H&PS) with exposure to complex, risky deals (>$50m portfolio value) with proven team management experience;
· Minimum of 5 years of experience supporting contracts with Government entities;
· Relevant experience with either Consulting, Outsourcing and Systems Integration deals in the Information Technology sector;
· Demonstrated experience leading Contract Management teams with good executive presence;
· Able to collaborate and communicate effectively with client contract management executives and be capable of contributing to key commercial and contracting decisions;
· Solid commercial experience with exposure to managing complex commercial issues and an understanding of commercial best practices; and
· Solid knowledge and understanding of the Italian Public Procurement Code (Legislative Decree 50/2016) and applications in both pre-award and post-award contract management.
Knowledge of Business Practices:
· Understanding of business practices at large corporations and/or government entities;
· Understanding of commercial contracting regulations and principles, subcontracting practices and accounting and finance principles;
· Ability to communicate business and contract management principles both in Italian and in English both in writing and verbally; and
· Exposure to commercial contracting regulations and principles.
Legal Knowledge and Experience:
· Advanced knowledge and understanding of legal processes and principles as they relate to commercial and contract management;
· Advanced knowledge and understanding of government contracting and contract management;
· Advanced knowledge and understanding of commercial and contract law; and
· Advanced knowledge of the commercial terms and conditions applicable to contracts for Avanade services.
